Terms of Service

Welcome to Jigg. These Terms of Service ("Terms") govern your access to and use of the Jigg mobile application and related services (collectively, the "Service"). By downloading, installing, or using Jigg, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

Jigg is a fishing application that allows users to:

• Log and record fish captures with photos and measurements
• Track fishing locations and statistics
• Participate in fishing competitions and tournaments
• Connect with other anglers in the community
• Access AI-powered fishing forecasts and insights
• View fish species information and regulations

2. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised access

You must be at least 13 years of age to create an account. Users under 18 must have parental or guardian consent.

3. Premium Subscription

Jigg offers a premium subscription ("Jigg Premium") that provides access to additional features and functionality.

3.1 Subscription Plans

We offer the following subscription options:

• Monthly Subscription: Billed monthly with a free trial period for new subscribers
• Annual Subscription: Billed annually at a discounted rate

Prices are displayed in your local currency within the app and may vary by region. All prices include applicable taxes.

3.2 Premium Features

Jigg Premium includes access to:

• AI-powered fishing forecast with personalised recommendations
• Heat maps and hot zone alerts
• Weather conditions for each capture
• Weather insights and trend analysis
• Fishing competitions and tournaments
• Friends competitions
• Species graphs and analytics
• Gear tracking
• Detailed species information
• Achievements and milestones
• Data export (PDF/CSV)
• Forecast notifications

3.3 Billing and Payment

Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase. Subscriptions are processed through the respective app store payment systems.

• Apple App Store: Payments are processed by Apple Inc. and subject to their payment terms
• Google Play Store: Payments are processed by Google LLC and subject to their payment terms

3.4 Automatic Renewal

Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate as your initial subscription, unless you change your subscription plan.

3.5 Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the free trial ends, you will be automatically charged for the subscription. Any unused portion of a free trial will be forfeited when you purchase a subscription.

3.6 Cancellation

You may cancel your subscription at any time through your app store account settings:

• iOS: Go to Settings > [Your Name] > Subscriptions > Jigg > Cancel Subscription
• Android: Go to Google Play Store > Menu > Subscriptions > Jigg > Cancel Subscription

Cancellation will take effect at the end of your current billing period. You will retain access to Premium features until then. Deleting the app does not cancel your subscription.

3.7 Refunds

Refund requests are handled by the respective app store (Apple or Google) according to their refund policies. We do not have the ability to process refunds directly. To request a refund:

• Google: Visit Google Play Help

4. User Content

You retain ownership of content you submit to Jigg (photos, capture data, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content in connection with the Service.

Jigg reserves the right to access, view, and analyse your capture data, including but not limited to photos, species information, measurements, and location data. We may also share your capture data with third parties for purposes including but not limited to research, analytics, marketing, competition verification, and partnership collaborations. Where practicable, shared data may be anonymised or aggregated, but this is not guaranteed.

You represent and warrant that:

• You own or have rights to submit the content
• Your content does not violate any third-party rights
• Your content complies with applicable laws and these Terms

5. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Submit false or misleading capture records
• Impersonate others or misrepresent your affiliation
• Submit fraudulent competition entries
• Harass, abuse, or harm other users
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorised access to any part of the Service
• Use automated systems to access the Service
• Reverse engineer or decompile any part of the Service

6. Competition Rules

When participating in Jigg competitions, you agree to:

• Submit only genuine captures with accurate measurements
• Follow all applicable fishing laws and regulations
• Comply with competition-specific rules and guidelines
• Accept disqualification for rule violations

We reserve the right to verify any capture and disqualify entries that appear fraudulent or do not comply with competition rules.

7. Business Accounts and Location Admins

Jigg allows third-party business operators ("Location Admins") such as fishing lodges, charter services, and bait shops to claim and manage location listings on our platform.

7.1 Data Sharing with Location Admins

Jigg reserves the right to share user engagement data and capture data with Location Admins. This may include, but is not limited to:

• Aggregated statistics about location visits and user engagement
• Capture data (including photos, species, and measurements) logged at or near their claimed locations
• User interaction data with their promotional deals
• Any other data Jigg deems relevant to their business operations

7.2 Location Admin Responsibilities

Location Admins who claim business listings agree to:

• Provide accurate business information
• Maintain an active paid subscription
• Comply with all applicable laws regarding data use and advertising
• Not misuse any user data shared with them through the platform

7.3 Third-Party Business Content

Promotional deals and business information displayed in the Service are provided by third-party Location Admins. Jigg is not responsible for the accuracy, legality, or quality of such content. Your interactions with Location Admins and any transactions arising from promotional deals are solely between you and the respective business.

7.4 No Expectation of Privacy from Location Admins

By using the Service, you acknowledge that your capture data, location data, and engagement activity may be visible to and shared with Location Admins who manage locations near where you fish or interact with within the app. You should have no expectation of privacy with respect to such data being accessible to these third-party business operators.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by Jigg and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THE ACCURACY OF FISHING FORECASTS, SPECIES IDENTIFICATION, OR OTHER PREDICTIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JIGG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Jigg, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the app settings. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Third-Party Services

The Service may integrate with or link to third-party services (such as payment processors, social networks, or mapping services). We are not responsible for the content, policies, or practices of these third parties. Your use of third-party services is at your own risk and subject to their respective terms.

15. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service shall be resolved in the courts of Australia. Nothing in these Terms excludes, restricts, or modifies any consumer rights under Australian Consumer Law.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
